AGENCY DISCLOSURE

The are 4 possible types of agency relationships:

1. Seller's Agent/Listing Agent

A seller's agent acts solely on the behalf of the seller, and owes fiduciary duties to the seller which include reasonable care, undivided loyalty, confidentiality, and full disclosure.

A seller's agent must act honestly and fairly. A seller's agent must also disclose all information known by the broker that is material to the transaction.

2. Buyer's Agent

A buyer's agent acts solely on behalf of the buyer. A buyer's agent has fiduciary duties to the buyer which include reasonable care, undivided loyalty, confidentiality, and full disclosure.

3. Dual Agent

Dual agency occurs when a real estate firm representing the seller also has a buyer for the property. A firm can represent both parties with the knowledge and written consent of the buyer and the seller. The agent must have permission of the party to disclose confidential information about price, terms, and motivation to sell or buy. Information available to the general public such as a comparative market analysis may be offered to both parties.

4. Designated Agent

In a dual agency situation,if the firm wishes, the broker may obtain your consent to appoint one designated agent within the firm to solely represent the buyer, and a different agent designated to represent the seller.
